Terms of Use

The use of this ICAO TRIP Platform constitutes agreement with the following terms and conditions:

(a) The International Civil Aviation Organization (ICAO) maintains this platform (the "Site") as a courtesy to those who may choose to access the Site ("Users"). The information presented herein is for informative purposes only. ICAO grants permission to Users to visit the Site and to download and copy the information, documents and materials (collectively, "Materials") from the Site for the User's personal, non-commercial use, without any right to resell or redistribute them or to compile or create derivative works therefrom, subject to the terms and conditions outlined below, and also subject to more specific restrictions that may apply to specific Material within this Site. (b) ICAO administers this Site. All Material on this Site from ICAO appears subject to the present Terms and Conditions. (c) Unless expressly stated otherwise, the findings, interpretations and conclusions expressed in the Materials on this Site are those of the various Users and do not necessarily represent the views of ICAO or its Member States.

Disclaimers

Materials provided on this Site are provided "as is", without warranty of any kind, either express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose and non-infringement. ICAO specifically does not make any warranties or representations as to the accuracy or completeness of any such Materials. ICAO periodically adds, changes, improves or updates the Materials on this Site without notice. Under no circumstances shall ICAO or its staff, officials or agents be liable for any loss, damage, liability or expense incurred or suffered that is claimed to have resulted from the use of this Site, including, without limitation, any fault, error, omission, interruption or delay with respect thereto. The use of this Site is at the User's sole risk. Under no circumstances, including but not limited to negligence, shall ICAO or its staff, officials or agents be liable for any direct, indirect, incidental, special or consequential damages, even if ICAO has been advised of the possibility of such damages. The User specifically acknowledges and agrees that ICAO or its staff, officials or agents are not liable for any conduct of any User. This site may contain advice, opinions and statements of various information providers. ICAO does not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information provided by any information provider, any User of this Site or any other person or entity. Reliance upon any such advice, opinion, statement, or other information shall also be at the User's own risk. Neither ICAO nor any of its respective agents, staff, officials, employees, information providers or content providers, shall be liable to any User or anyone else for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content herein, or for its timeliness or completeness, nor shall they be liable for any failure of performance, computer virus or communication line failure, regardless of cause, or for any damages resulting therefrom. ICAO, its staff, officials or agents will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this Site:

As a condition of use of this Site, the User agrees to indemnify ICAO, its staff, officials and agents from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of the User's use of this Site, including, without limitation, any claims alleging facts that if true would constitute a breach by the User of these Terms and Conditions. If the User is dissatisfied with any Material on this Site or with any of its Terms and Conditions of Use, the User's sole and exclusive remedy is to discontinue using the Site.

This Site may contain links and references to third-party web sites. The linked sites are not under the control of ICAO, and ICAO is not responsible for the content of any linked site or any link contained in a linked site. ICAO provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked site by ICAO.

If this Site contains bulletin boards, chat rooms, access to mailing lists or other message or communication facilities (collectively, "Forums"), the User agrees to use the Forums only to send and receive messages and materials that are proper and related to the particular Forum.

In order to access certain portions and features of the Site, you may have to create a “username” and complete an account registration process. If you do so, you agree to provide accurate, current, and complete information about yourself as prompted by the Site's registration forms. You also agree to update your account information in a prompt manner in order to keep it true, accurate, current and complete. You are responsible for maintaining the confidentiality of your account password and username, and are fully responsible for all activities that occur under your password or username. Please immediately notify ICAO of any unauthorized use of your password or username or any other breach of security.

By way of example and not as a limitation, the User agrees that when using a Forum, he or she shall not do any of the following:

(a) Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;
(b) Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information;
(c) Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity) unless the User owns or controls the rights thereto or has received all consents therefor as may be required by law;
(d) Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another's computer;
(e) Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;
(f) Falsify the origin or source of software or other material contained in a file that is uploaded;
(g) Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another user of a Forum that the User knows, or reasonably should know, cannot be legally distributed in such manner.

The User acknowledges that all Forums and discussion groups may be public to other Users of the Site and not private communications. Further, the User acknowledges that chats, postings, conferences, e-mails and other communications by other Users are not endorsed by ICAO, and that such communications shall not be considered to have been reviewed, screened or approved by ICAO. ICAO reserves the right to remove, for any reason and without notice, any content of the Forums received from Users, including, without limitation, e-mail and bulletin board postings.

License to use Site

Unless otherwise stated, ICAO and/or its licensors own the intellectual property rights in the Site and material on the Site. Subject to the license below, all these intellectual property rights are reserved. You may view, download for caching purposes only, and print pages or any other content from the Site for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions. You must not:

Acceptable use

You must not use this Site in any way that causes, or may cause, damage to the Site or impairment of the availability or accessibility of the Site; or in any way which is unlawful, illegal, fraudulent, immoral or harmful, or in connection with any unlawful, illegal, fraudulent, immoral or harmful purpose or activity. You must not use this Site to copy, store, host, transmit, send, use, publish or distribute any material which consists of or is linked to any spyware, computer virus, Trojan horse, worm, keystroke logger, root kit or other malicious or illegal computer software. You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this Site without ICAO’s express written consent. You must not use this Site to transmit or send unsolicited commercial communications. You must not use this Site for any purposes related to marketing without ICAO’s express written consent.

Restricted access

Access to certain areas of this Site is restricted. ICAO reserves the right to restrict access to certain areas of this Site, or indeed this entire Site, at ICAO’s discretion. If ICAO provides you with a user ID and password to enable you to access restricted areas of this Site or other content or services, you must ensure that the user ID and password are kept confidential. ICAO may disable your user ID and password in ICAO’s sole discretion without notice or explanation.

User content

In these terms and conditions, “your user content” means material (including without limitation text, images, audio material, video material and audio-visual material) that you submit to this Site, for whatever purpose. You grant to ICAO a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media. You also grant to ICAO the right to sub-license these rights, and the right to bring an action for infringement of these rights. Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or ICAO or a third party (in each case under any applicable law). You must not submit any user content to the Site that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint. ICAO reserves the right to edit or remove any material submitted to this Site, or stored on ICAO’s servers, or hosted or published upon this Site. Notwithstanding ICAO’s rights under these terms and conditions in relation to user content, ICAO does not undertake to monitor the submission of such content to, or the publication of such content on, this Site.

Reasonableness

By using this Site, you agree that the exclusions and limitations of liability set out in this Site disclaimer are reasonable. If you do not think they are reasonable, you must not use this Site.

Other parties

You accept that, as a limited liability entity, ICAO has an interest in limiting the personal liability of its staff, officers and employees. You agree that you will not bring any claim personally against ICAO’s staff, officers or employees in respect of any losses you suffer in connection with the Site. Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this Site disclaimer will protect ICAO’s staff, officials, officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as ICAO.

Unenforceable provisions

If any provision of this Site disclaimer is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this Site disclaimer.

Breaches of these terms and conditions

Without prejudice to ICAO’s other rights under these terms and conditions, if you breach these terms and conditions in any way, ICAO may take such action as ICAO deems appropriate to deal with the breach, including suspending your access to the Site, prohibiting you from accessing the Site, blocking computers using your IP address from accessing the Site, contacting your internet service provider to request that they block your access to the Site and/or bringing court proceedings against you.

Miscellaneous

These Terms and Conditions may be amended by ICAO from time to time at our sole discretion. Upon amendment, we will place a notice on this Site. Please periodically review the controlling version of these Terms and Conditions. By continuing to use the Site subsequent to ICAO making available an amended version of these Terms and Conditions, you thereby acknowledge, agree, and consent to such amendment. The failure of ICAO to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. No waiver by ICAO of any provision of this Agreement shall be binding except as set forth in writing and signed by its duly authorized representative. These Terms and Conditions are fully assignable by ICAO and will be binding upon and inure to the benefit of our successors and assigns. No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by these Terms and Conditions. You agree not make any public statements that assert or imply any relationship with ICAO, unless you have ICAO’s prior written approval. ICAO reserves all rights not expressly granted under these Terms and Conditions, and no other rights are granted by implication or estoppel or otherwise. The headings in these Terms and Conditions are for convenience only and have no legal or contractual effect. Nothing contained herein shall constitute, express or implied, any waiver of the privileges and immunities of ICAO.

Geographic Representations

The designations employed and the presentations of the information on this Site do not imply the expression of any opinion whatsoever on the part of the Secretariat of the International Civil Aviation Organization concerning the legal status of any country, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries.
